Re: Jon Chait Can’t Read

Re: Jon Chait Can’t Read

Kevin , a thousand times yes! I’ll add one more thing. Chait complains: Okay. First we have this business about “impoundment power,” which entails magically re-writing the relationship between the White House and Congress. (All efforts to date to give the president line-item veto power have run aground in the courts.) Even if this process could magically occur overnight — and Daniels is talking about a short-term plan — it does not specify which spending programs he would impound. I think Chait’s point about Daniels not laying …

Texas Court: Don’t Mess With Marriage

Texas Court: Don’t Mess With Marriage

Earlier this week, an appeals court in Texas ruled that Texas courts do not have jurisdiction to grant divorces to same-sex couples married in other states. The principle is simple: no valid marriage, no divorce. The Rhode Island Supreme Court issued a similar ruling a few years ago. The Texas court did note that the couple can get a declaration that the marriage is void, which would have the same effect as a divorce in ending the legal relationship. The couple involved in the case had also raised the …

Oh My Dear Sweet Lord: Rightwing Tea Party “Anti-Immigrant” Extremist Turns Out To Have Been Convicted For… Human Smuggling of Illegal Immigrants

So… this guy’s a rightwinger because in his general screed against parasitic human babies he mentioned he didn’t like “anchor babies” either? Turns out his relationship with illegal immigrants was a little more complex than that. James Lee, the bomb-laden…

Eric W. Deaton — the Ohio Constitution Party candidate for U.S. Senate who was indicted on Tuesday for unlawful sexual conduct with a minor — met the victim at a church where he was an elder, a police official told TPMMuckraker. The pastor of the church first brought concerns about the relationship to between the girl, now 18, and 42-year-old Deaton and an investigation started last October, according …

Gallup: Generic ballot shows record Republican lead

Gallup: Generic ballot shows record Republican lead

I’ve had my ups and downs with Gallup (one might say the relationship is like the plot of the Gallup generic ballot itself!), but since they’ve been solidly running registered voter surveys again, the numbers have looked reasonable. But now they’re shocking us from the other direction by showing the Republicans having their largest ever lead in the generic ballot survey, showing a larger edge than even today’s Rasmussen’s GOP +6 (notwithstanding the alleged House Effect of the latter). This Gallup result is so large, I had to see what it shows…

Living in Sin and Judicial Activism

Living in Sin and Judicial Activism

(Eugene Volokh) From today’s In re the Petition of Theresa Goudeau to Adopt a Minor Child (Ga. Ct. App.), 2010 WL 3369363 (some paragraph breaks added) (opinion not yet on any free online site, to my knowledge). I should say that the trial court’s decision to take a child away from foster parents because they’re an unmarried couple — and to deny the foster mother’s adoption petition because she’s living with her boyfriend — appears to me to be not only against Georgia law but also cruel. Whatever might be the merits of a preference for married parents over unmarried parents in such matters, the court of appeals was surely right that “to …

Levi Johnston Recants Apology to Palins, CBS Rewards with Four-Minute ‘Exclusive’

Levi Johnston Recants Apology to Palins, CBS Rewards with Four-Minute ‘Exclusive’

Continuing their obsession with the credibility-challenged Levi Johnston, whose sole claim to fame is his continuing ability to exploit his relationship with Sarah Palin’s daughter, Bristol, CBS’s The Early Show on Friday devoted more than four minutes to an “exclusive” interview with the “reality star” and how he now recants his apology for lying about the Palins in previous interviews. To her credit, correspondent Betty Nguyen challenged Johnston’s openly frivolous approach to running for mayor of Wasilla, Alaska (a stunt concocted for a reality show) and whether his temporary apology was “honest” (he said it was “something I did to make my…

Medieval legal history panel at the Kalamazoo medieval conference

Medieval legal history panel at the Kalamazoo medieval conference

(Sasha Volokh) Cornell historian Paul Hyams and I are organizing a panel on medieval legal history at the International Congress on Medieval Studies at Kalamazoo, Michigan, May 12–15, 2011. Here’s the call for papers: In the high middle ages, land in medieval Europe was the most important source of political power, social status, and material wealth. Even in the earlier centuries. control over land was a [rime goal for the ambitious, and much conflict was fought out as disputes over its control and enjoyment. So land title and the vocabulary and discourse with which it was contested occupies a rather central …

NYT’s Charles Blow: Obama Is Not Good For Jews

“Is President Obama good for the Jews?” asked New York Times columnist Charles Blow Saturday. His answer was quite surprising: “For more and more Jewish-Americans, the answer is no.” In his piece marvelously titled “Oy Vey, Obama,” Blow referred to Thursday’s Pew Research Center report finding “33% of Jewish voters identify with or lean toward the Republican Party…
